Article 2 – Scope
These general terms and conditions of sale (GTC) apply to any order placed on the website by a consumer, a natural person acting for non-professional purposes ("the customer"). They override any other document. The customer declares to have read and accepted them before confirming their order. The applicable version is the one in force on the day the order is placed.
Article 3 – Products
The essential characteristics of the products (composition, sizes, care) are presented on each product page. The photographs are as accurate as possible; slight color variations may occur depending on the screen. A size guide is available on the website. Products are offered subject to availability. If an item becomes unavailable after the order is placed, the customer will be informed by email and refunded without delay, within 14 days at the latest.
Article 4 – Prices
Prices are indicated in euros, all taxes included (TTC), excluding delivery costs. The total amount, including delivery costs, is displayed before the order is confirmed. Products are charged at the price in force at the time the order is placed.
Article 5 – Order
To place an order, the customer adds the items to their cart, checks their selection, enters their contact details, chooses the delivery method, and then confirms payment. The order is final upon payment confirmation. A summary email is sent to the customer; it serves as an acknowledgment of receipt. Rose & Matcha may refuse an order in the event of an unresolved prior dispute or an unusual order.
Article 6 – Payment
Payment is due at the time the order is placed. It is made online, securely, by credit card (Visa, Mastercard, Carte Bancaire), Apple Pay, or Shop Pay. Payment data is processed by the payment service provider and is never retained by Rose & Matcha. The products remain the property of Rose & Matcha until full payment of the price.
Article 7 – Delivery
Carrier and areas. Orders are shipped by Colissimo, with tracking, to mainland France (including Corsica), Europe, and the rest of the world, in countries served by the carrier. The available destinations are presented at the time the order is placed.
Estimated delivery times (from shipment): mainland France, 2 to 3 business days; Europe, 3 to 8 business days; rest of the world, 5 to 15 business days. In any event, delivery will take place no later than 30 days after the order is placed.
Costs. Delivery costs depend on the destination and the package; they are indicated before payment. Delivery in France is free for purchases of €150 or more.
Customs duties and taxes. For deliveries outside the European Union, customs duties, import taxes, and customs clearance fees may be required by the destination country. Unless stated otherwise at the time the order is placed, they are the responsibility of the recipient and are payable upon receipt of the package.
In-store pickup. The customer may choose free in-store pickup at the boutique located at 3 rue de la Citadelle in Porto-Vecchio, during opening hours (the boutique is closed in January and February). They will be notified by email when their order is ready and can collect it upon presentation of this email.
Receipt. Risks are transferred to the customer upon delivery of the package. In the event of a damaged or incomplete package, the customer must report it to the carrier and notify us within 48 hours at chezrosematcha@gmail.com, with supporting photographs. In the event of a delay of more than 30 days, the customer may cancel their order and receive a refund.
Right of withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the customer has 14 days from receipt of the products to withdraw, without having to justify their decision. They must notify us of their decision by email at chezrosematcha@gmail.com, by any unambiguous statement, or by using the form below. They must then return the products within 14 days of this notification, in good condition, unworn, and with their labels attached. Return costs are borne by the customer, except in the event of a defective item or an error on our part.
Rose & Matcha will refund the full amount paid, including the initial delivery costs (based on the standard delivery method), no later than 14 days after being informed of the withdrawal, by the same payment method. The refund may be deferred until receipt of the products or proof of their shipment. The customer may be held liable for any depreciation of the products resulting from handling other than that necessary to establish their nature and characteristics.
Exceptions (Article L.221-28): the right of withdrawal does not apply to products made to the customer's specifications or clearly personalized, nor to products unsealed after delivery that cannot be returned for hygiene or health protection reasons.

Article 8 – Legal warranties
All products are covered by the legal warranty of conformity and the warranty against hidden defects.
The consumer has two years from the delivery of the item to claim the legal warranty of conformity in the event of a conformity defect. During this period, they are only required to establish the existence of the conformity defect, not the date of its appearance. The legal warranty of conformity entitles the consumer to have the item repaired or replaced free of charge and without major inconvenience within thirty days of the request. The consumer may obtain a price reduction while keeping the item, or terminate the contract and receive a full refund upon return of the item if the trader refuses to repair or replace the item, if the repair or replacement takes place after thirty days, or if a new defect appears. These rights result from Articles L.217-1 to L.217-32 of the French Consumer Code. A seller who unlawfully prevents the enforcement of the legal warranty of conformity may be subject to a civil fine (Article L.241-5 of the French Consumer Code).
The consumer also benefits from the legal warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code) for two years from the discovery of the defect. It entitles the consumer to a price reduction if the item is kept, or a full refund upon return of the item.
For any request, contact chezrosematcha@gmail.com, providing the order number and a photograph of the defect. Return costs for a defective or non-conforming item are borne by Rose & Matcha.
Article 9 – Liability
Rose & Matcha is not liable for non-performance of the contract due to force majeure, the act of a third party, or the customer. Links to other websites do not bind Rose & Matcha.
Article 10 – Personal data
The data collected is necessary for processing orders and customer relations. It is retained for the duration necessary to fulfill these purposes and legal obligations. In accordance with the GDPR, the customer has the right to access, rectify, erase, limit, transfer, and object, which may be exercised at chezrosematcha@gmail.com. They may file a complaint with the CNIL. More information is available in our privacy policy.
Article 11 – Evidence and archiving
Computerized records kept in the website's systems serve as proof of orders and payments. The contract is archived, and the customer may access it upon request.
Article 12 – Complaints and mediation
In the event of a complaint, the customer should contact customer service at chezrosematcha@gmail.com or 07 80 62 76 97. Rose & Matcha undertakes to seek an amicable solution. The contact details of the consumer mediator to whom Rose & Matcha is subject will be specified in these terms.
Article 13 – Applicable law
These GTC are written in French and subject to French law. In the event of a dispute, French courts shall have jurisdiction, subject to mandatory consumer protection rules.
